Welcome to Hossain Lighting (the "Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and online multi-vendor marketplace services.
Please read these Terms carefully before using the Platform. By accessing, browsing, or creating an account on Hossain Lighting, you agree to be bound by these Terms and our integrated Privacy Policy, Seller Policy, and Return Policy. If you do not agree to all of these Terms, you must immediately discontinue use of the Platform.
1. About the Marketplace
Hossain Lighting operates as a premium, multi-vendor electronic commerce platform. We provide a digital marketplace destination where independent third-party vendors ("Sellers") list, market, and sell lighting fixtures and related accessories to global buyers ("Buyers").
Important Clarification: Unless explicitly stated otherwise on a specific product listing, Hossain Lighting does not manufacture, stock, quality-check, or directly ship the items sold on the Platform. The contract for any sale is formed directly between the Buyer and the Seller.
2. User Accounts & Registration
To access certain features of the Platform, including making purchases or listing products, you must register for an account.
Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
Security: You are solely responsible for maintaining the confidentiality of your account credentials (password and username) and for all activities that occur under your account.
Age Restrictions: By using this Platform, you represent that you are at least 18 years of age and possess the legal capacity to enter into binding contracts.
3. Marketplace Pricing & Payments
Pricing Currency: All prices displayed on the Platform are determined by the respective Sellers and are subject to change without notice. Prices may exclude applicable taxes, customs duties, and shipping fees, which will be calculated at checkout.
Payment Processing: We utilize secure, third-party payment gateways to process financial transactions. By completing a purchase, you authorize our payment processors to charge your selected payment method.
Order Erasures & Corrections: Sellers and Hossain Lighting reserve the right to cancel or refuse any order if a product is listed at an incorrect price or with erroneous structural specifications due to typographical or technical errors.
4. Product Descriptions & Safety
Accurate Descriptions: We endeavor to ensure that all marketplace content is clear and accurate. However, Hossain Lighting does not warrant that product descriptions, color renderings, technical dimensions, or photographs uploaded by third-party Sellers are completely error-free or perfectly precise.
Electrical Safety Compliance: Buyers are responsible for ensuring that the voltage, wattage, and electrical certifications (e.g., CE, UL) of the ordered light fixtures are fully compatible with their local regional grid and building safety codes before installation.
5. Intellectual Property Rights
Platform Content: All materials, layout, code, graphics, branding, trade names, and user interface designs on Hossain Lighting are the exclusive intellectual property of Hossain Lighting or its licensors.
User & Vendor Submissions: By uploading text, product descriptions, reviews, or images to the Platform, you grant Hossain Lighting a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that content for marketing and operational purposes.
6. Prohibited Activities
Users of the Platform are strictly prohibited from engaging in any of the following conduct:
Violating local, national, or international laws, or infringing upon the intellectual property rights of others.
Attempting to circumvent the Platform's fee structure by conducting off-platform transactions or sharing direct contact info in public forums.
Uploading malicious code, viruses, or deploying automated scrapers, bots, or data-mining tools on our infrastructure.
Manipulating the rating and review system through fraudulent feedback or targeted spamming.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Hossain Lighting, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Loss of profits, data, use, goodwill, or other intangible losses resulting from your use or inability to use the Platform.
Structural damage, electrical fires, personal injury, or property damage resulting from the installation, use, or failure of any lighting fixture purchased through our marketplace.
The conduct, listings, or structural quality of items provided by independent third-party Sellers.
8. Indemnification
You agree to defend, indemnify, and hold harmless Hossain Lighting, its parent companies, subsidiaries, and vendors from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected to your breach of these Terms, your misuse of the Platform, or your violation of any third-party rights.
9. Termination of Use
We reserve the right, without notice and at our sole discretion, to terminate or suspend your account and your access to the Platform for any behavior that we believe violates these Terms, harms other users, or damages the commercial reputation of Hossain Lighting.
10. Governing Law & Jurisdiction
These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the jurisdiction in which Hossain Lighting's corporate headquarters is registered, without regard to its conflict of law principles. Any legal disputes or claims arising under these terms shall be subject to the exclusive jurisdiction of the local courts.
11. Amendments to the Terms
Hossain Lighting reserves the right to update, modify, or replace these Terms and Conditions at any time. We will indicate changes by updating the "Effective Date" at the top of this document. Continued use of the Platform following any modifications constitutes explicit acceptance of the updated Terms.
